The Final Hearing

If a claim does not settle a Final Hearing will take place in front of an Employment Judge alone or in front of a panel with an Employment Judge and two lay representatives one representing industry and the other with a trade union background.

Commonly barristers are appointed to represent either or both parties although solicitors, other representatives and indeed Claimants and Respondents can represent themselves in Employment Tribunals.

A final hearing usually includes a remedies hearing if the Claimant is successful but it is not uncommon for hearings to run over and go part-heard or for only liability to be dealt with leaving remedies to another later hearing if the Claimant has been successful with his or her claim.
